Section 504 of the
Rehabilitation Act of 1973
Section 504 of the Rehabilitation Act of 1973 is a civil
rights statute which provides that: “No qualified individual with
disabilities shall, solely by reason of his/her disability, be excluded
from the participation in, be denied the benefits of, or be subjected to
discrimination under any program or activity receiving federal financial
assistance.
Section 504 of the Act protects persons from
discrimination based upon their disability status. A person is disabled
under the definition of Section 504 if he or she:

Has a mental or physical impairment which substantially
limits one or more of such person’s major life activities;

Has a record of such impairments; or
-
Is regarded as having such an impairment.
“Major life activities” include functions such as caring
for one’s self, performing manual tasks, walking, seeing, hearing,
speaking, breathing, learning, and working. Section 504 guarantees a
free appropriate public education (FAPE) for students with disabilities
in public schools. “Appropriate” requires that students with
disabilities be provided with necessary accommodations. It also requires
that students with disabilities be provided with an education comparable
to that provided to students without disabilities. Schools must provide
access to programs and facilities that offer an opportunity for
meaningful participation for qualifying individuals with disabilities.
In the office of each school in the district there is a copy of Section
504 Procedures Manual (revised July 2002).
The Francis Howell School District has a duty and
